General informations

These General Conditions of Sale concern the purchase of products via a telematic network on the website www.bottegadartetoscana.it, belonging to Bottega d’Arte Toscana of Silvia Salvadori , headquartered in Via Bicchieraia, 24 52100 – Arezzo, Italy. Each purchase transaction will be governed by the provisions of DLgs.185/99, DLgs. 206/05; the information intended to conclude the contract will be submitted to art. 12 of the DLgs.70/03 and, with regard to the protection of privacy, will be subject to the provisions of the DLgs. 196/03.

Conclusion of the contract and acceptance of the general conditions of sale

The sales contracts of the products on the website www.bottegadartetoscana.it are considered to be concluded at the time when the purchase order is made by the customer at Bottega d’Arte Toscana of Silvia Salvadori and the latter accepts it. Silvia Salvadori’s Tuscan Bottle Art will promptly send the customer of the purchase order made.

The customer, with the electronic submission of his purchase order, declares that he has taken a view and has accepted these general terms of contract and is obligated to observe them and respect them in the relations with the Bottega d’Arte Toscana of Silvia Salvadori .

Treatment of personal data

Art Gallery of Tuscany by Silvia Salvadori , pursuant to art. 13 of Legislative Decree 196/2003, informs that personal data obtained also verbally in relation to the commercial relationships established, directly provided by the parties concerned or otherwise acquired in the course of the activity of the company, will be subject to treatment in accordance with the regulations referred to, including confidentiality requirements.

With respect to the predecessors, the rights under Article 7 DLgs can be exercised. 196/2003.

Obligations of the Customer

Before submitting your purchase order, Customer is required to read carefully these general sales conditions. Forwarding the purchase order implies their full knowledge and acceptance.

Lastly, once the online shopping process has been completed, the Customer is required to print and maintain these general sales conditions, which have already been viewed and accepted during the termination of the contract.

Defining the Order

By submitting the online order, Customer submits to Silvia Salvadori Bottega d’Arte Toscana a proposal to purchase the product and / or the products placed in the cart. When you place an online order for the products you have placed in your shopping cart, you agree to purchase them at the price and the terms indicated in these General Sales Conditions.

Silvia Salvadori’s Art Gallery of Tuscany will inform the customer of the acceptance and confirmation of the order.

In particular, Silvia Salvadori’s Bottega d’Arte Toscana will not accept orders:

  • if the material at the time of order was not available in stock
  • if the Customer can not or does not want to pay by bank transfer or Cash on delivery.

How to buy

The customer purchases the product, whose features are illustrated online in the descriptive descriptions, at the price indicated there, plus the delivery costs specified on the site. (excluding any payment for marking).
Before the purchase order is forwarded, the unit cost of each product selected, the total cost when purchasing multiple products and the related delivery costs are summarized.

Once the purchase order has been submitted, the customer will receive from Silvia Salvadori’s Bottega d’Arte Toscana an e-mail confirming receipt of the purchase order and containing information on the main features of the purchased item, a detailed indication of the price, delivery costs, applicable fees and means of payment and containing a reference to the general conditions of contract and information on the existence of the right of withdrawal, the terms and conditions of its exercise displayed on the website . Following the approval of Law Decree 4 July 2006, no. 223 “maneuvering” Article 37 paragraphs 8 and 9, converted with Law 248 of 4 August 2006, which entered into force on August 12, 2006, which restores the obligation to communicate the list of customers and suppliers in case of issue bill, and Law Decree 78 of May 31, 2010 converted into Law 122 of July 30, 2010, requires the need to request customers to communicate VAT IDENTIFICATION and CODE TAX in the relevant fields on the site.

Payment

The customer can make the payment due by choosing one of the following methods listed.

  • Payment cash on delivery: Payment by cash on delivery is accepted only if made by cash or circular check; consequently, pursuant to and for the purposes of art. 1197 of the Italian Civil Code, no payments made by simple bank check will be accepted. The payment on delivery will be subject to a surcharge which will be communicated to the customer following each order made. This fee is to be charged only and exclusively to the Courier Service chosen and used by Bottega d’Arte Toscana by Silvia Salvadori
  • Payment by bank transfer: Payment by bank transfer can be made using bank transfer. Details will be sent by mail after receipt of the order

If the payment is made by bank transfer, the purchased item will be shipped with the methods described in the next paragraph “Delivery of Products” to the address indicated by the customer upon receipt of the credit, so on average within two / five days after the execution of the transfer (the times vary depending on the Credit Institution used). You can send the payment receipt together with your order number by e-mail to: info@bottegadartetoscana.it

Delivery of products

The purchased item, together with the relevant invoice when required, is delivered by courier to the address specified by the customer at the time of ordering on-line. Any specific needs will have to be considered by the customer at Silvia Salvadori’s Bottega d’Arte Toscana .

Silvia Salvadori’s Bottega d’Arte Toscana guarantees the delivery of the goods within 4 (four) working days within the national territory and within 7 (seven) working days on international territory from the date of receipt of the payment. In the event that the customer chooses the way of delivery on the mark, the payment must be made exclusively through cash or circular check, to be delivered directly to the courier at the time of receipt of the goods.

In case of non-delivery due to the absence of the recipient, to the address indicated by him in the order, the courier will leave a warning and will repeat a second time; if the recipient is still missing, the goods will be returned to the sender (Bottega d’Arte Toscana by Silvia Salvadori).

Compliance Warranty and Defective Products

The products purchased on www.bottegadartetoscana.it are subject to the rules on the sale of consumer goods.The delivered products conform to the features illustrated on-line in their descriptive descriptions.

Silvia Salvadori’s Bottega d’Arte Toscana is responsible to the customer for any defective compliance at the time of delivery of the good.

Right of withdrawal

The consumer can exercise the right of withdrawal. In particular, the consumer has the right to withdraw from any contract concluded with Bottega d’Arte Toscana by Silvia Salvadori , without any penalty and without specifying the reason, within 10 (ten) working days from receipt of the goods.
The right of withdrawal is recognized by the consumer in relation to any goods purchased by him on www.bottegadartetoscana.it.

How to exercise the right of withdrawal

The right of withdrawal is exercised by the sending of a written notice to the address of the Bottega d’Arte Toscana of Silvia Salvadori by registered letter with acknowledgment of receipt.

The notice of withdrawal may be sent by mail within the same time period, provided that it is confirmed by registered letter with acknowledgment of receipt within 48 hours.

If the goods have been delivered, the customer is required to return it to Bottega d’Arte Toscana by Silvia Salvadori within 15 (fifteen) working days from the date of delivery of the goods. The good is returned to Bottega d’Arte Toscana by Silvia Salvadori complete with every accessory and everything originally delivered to the customer, as well as packed in its original envelopes. The returned product must be accompanied by a copy of the electronic receipt of the order. The costs of returning the goods to Bottega d’Arte Toscana by Silvia Salvadori are the responsibility of the customer.

If the right of withdrawal is exercised by the customer in accordance with the provisions of this clause, Silvia Salvadori’s Bottega d’Arte Toscana is required to repay the sums paid by the customer. In particular, Silvia Salvadori’s Bottega d’Arte Toscana will proceed to the transfer of the redemption order for the cost of the shipped item including the shipping costs within 30 (thirty) days from the date on which it becomes aware of the exercise of the right withdrawal by the customer. This will be done by crediting the amount on the bank account indicated by the customer.

Silvia Salvadori’s Bottega d’Arte Toscana has the right to reject any product returned in a manner other than those specified above, as well as products for which the customer has not fully paid for the refund or the methods and the times indicated for the communication of the exercise of the right of withdrawal.

Expressive clause

In case of total or partial payment of the purchase price of the goods, Silvia Salvadori Bottega d’Arte Toscana reserves the right to declare under the terms and for the effects of art. 1456 of the Civil Code resolved this contract by sending a written communication to the customer’s electronic address.

For any claim or clarification, the customer must contact the number (+39) 349-6542142 or the e-mail address info@bottegadartetoscana.it. The customer will be contacted for clarification within 3 (three) working days of the request.

Applicable Law and Competent Burial

This contract is governed by Italian law. The Court of Arezzo shall have sole jurisdiction and exclusive jurisdiction for any legal action brought by the Purchaser under this warranty or any further legal assurance. In the event of a win by Bottega d’Arte Toscana of Silvia Salvadori in any eventual legal action, the plaintiff will have to reimburse to Silvia Salvadori’s Bottega d’Arte Toscana the expenses, including lawyers’ fees and court fees, incurred by Silvia Salvadori’s Bottega d’Arte Toscana for his defense.

Postponement

As far as not expressly provided in this contract, the applicable Italian law is applicable.
